Data Protection and Constitutional Rights in India
Abstract
In the digital era, personal data has become one of the most valuable resources. The rapid growth of technology, social media, online banking, e-commerce, and artificial intelligence has increased the collection and processing of personal information. In India, concerns regarding misuse of personal data, cybercrime, surveillance, and privacy violations have also increased significantly. Data protection has therefore become closely connected with constitutional rights such as the Right to Privacy, Freedom of Speech, and Right to Equality guaranteed under the Indian Constitution.
The landmark judgment of Justice K.S. Puttaswamy vs Union of India (2017) recognized privacy as a fundamental right under Article 21 of the Constitution. This judgment created a strong constitutional foundation for data protection laws in India. The Digital Personal Data Protection Act, 2023 was introduced to regulate the collection, storage, and use of personal data while protecting citizens’ rights. However, challenges such as lack of awareness, cyber threats, government surveillance, and misuse of technology continue to exist.
This research paper examines the relationship between data protection and constitutional rights in India. It discusses constitutional provisions, legal frameworks, challenges, and the role of technology in ensuring privacy and security. The paper also provides recommendations for strengthening digital rights and protecting citizens in the modern technological environment
