UNDERSTANDING OF CONSTRUCTION DISPUTES: A SOUTH AFRICAN CASE STUDY

Abstract


Construction contracts govern construction projects. It is during the management of these contracts that disputes arise. The problem of disputes in construction projects is acknowledged globally and is often addressed post facto. Dispute resolution mechanisms in place can often be costly. Over and above that, a dispute once resolved may be costly to settle. Prevention of disputes will ensure cost and time saving. It is therefore clear that more research is necessary to strengthen attempts to eliminate disputes in construction contracts. In order to address this problem, a research to understand the disputes in construction was undertaken.
